BB&D Obtains Arbitration Award in Construction Dispute

BB&D attorneys Thom Avery and Aaron Sanders represented a construction company involved in the design and construction of multiple branch offices for an out-of-state financial institution.  After expending substantial resources in the design of one of the branch locations and readying the project for construction, the project was abruptly terminated by the financial institution.  The financial institution refused payment of the expenses incurred by BB&D’s client, prompting BB&D to seek enforcement of the rights granted pursuant to an arbitration clause in the parties’ contract.  Following testimony from both parties in a day-long arbitration hearing, the arbitrator awarded BB&D’s client virtually all of its expenses incurred on the project and ordered the payment of costs and attorneys’ fees incurred by BB&D’s client in bringing the arbitration claim.
