Contractual Disputes

Construction Litigation
Our attorneys have litigated and negotiated many complex commercial construction claims. Such work requires an understanding of the form contracts often used in large-scale construction projects and their interpretation, the various roles and duties assigned to parties such as the owner, general contractor, and architect with respect to contract administration, technical aspects of the construction, lien law, and complex litigation in general. Furthermore, construction litigation often also involves issues related to insurance coverage, policy exclusions and claims processing. Blitz, Bardgett & Deutsch is able to coordinate all aspects of this work to achieve superlative results for its clients. Firm attorneys have also handled numerous other construction litigation claims that concerned proper performance issues, abandonment, Ideker claims, delay claims, prompt payments issues and prevailing wage matters.

Employment Covenants & Employment Issues
Employment covenants have engendered their own, specialized area of the law that requires attorneys to be up-to-date and focused on details. The firm has represented both plaintiffs and defendants with respect to employment covenants and knows the law concerning trade secrets, customer contacts, and employee solicitation on which covenants rise or fall. In addition, firm attorneys are knowledgeable concerning the various claims that often attend employee covenants, such as civil conspiracy and tortious interference claims and claims based on the Missouri Uniform Trade Secrets Act.

Exclusivity Contracts
Virtually all business litigation will relate to, and likely depend on, the language and provisions of a contract. Lawyers at Blitz, Bardgett & Deutsch have successfully handled contract-based litigation spanning innumerable industries and circumstances. In addition, even when no litigation is filed, firm attorneys are adept at evaluating contract language and negotiating on the basis of those evaluations. The attorneys at Blitz, Bardgett & Deutsch are intimately familiar with, and have created law concerning all varieties of contract issues, including factual and equitable contract defenses, the enforceability of arbitration provisions, choice of law and venue, parol evidence, the statute of frauds, and many more.

Insurance
Businesses are inevitably and constantly faced with a myriad of insurance issues. Blitz, Bardgett & Deutsch is able to advise its clients on every aspect of these issues, including coverage disputes, taking insurance companies to court for vexatious refusal to pay claims, analyzing notice provisions found in all insurance policies, and considering potential third-party claims against insurance agents. Whether these issues are the main claims in a case or are ancillary to defending claims brought in a lawsuit (i.e., declaring a duty to defend and a duty to indemnify or responding to reservation of rights letters), the firm can resolve them in the client’s favor.
